HILLSBOROUGH JUDICIAL SURVEY RESULTS

Methodology: Judicial Survey of judges (in both Civil and Criminal divisions) in the 6th and 13th Circuits covering Hillsborough, Pinellas, and Pasco Counties. The survey was open to private Attorneys (both civil and criminal defense), prosecutors, assistant public defenders, and government attorneys. There are approximately 10,000 lawyers practicing in these three counties. Last year 3,200 invites were emailed to 6th Circuit attorneys. This year about 5,000 invites were sent to 13th Circuit attorneys. Ballots were sent to attorneys requesting ballots last year from the 6th Circuit and to those requesting ballots this year from both circuits, total approximately 382 (attorneys from the three counties).  120 attorneys cast a ballot.  Below is the survey results for Hillsborough County.

Each judge was rated on 5 categories and attorneys were given an opportunity to provide positive feedback (negative comments are published below (after results) for Hillsborough County with a committee note ). Voters were made to certify prior to being allowed to participate in survey that they would, 1) Not provide a rating if they were unfamiliar with a judge; 2) Cast a rating devoid of any personal feelings towards any judge and based only on the categories.

* This is not a scientific survey. All the encrypted ballots were cast electronically. Six attorneys accepted appointment to act as polling officers to oversee the integrity of the survey process and results. The individual ratings are anonymous and polling officers only had access to overall scores  in each category.  The polling officers were unable to link ratings and comments to participants.

This is the second annual judicial survey sponsored by the Committee Promoting Judidical Excellence (“CPJE”). This year’s judicial survey for Hillsborough County was co-sponsored by Sammis Law Firm.

CPJE is non-partisan group of attorneys that seeks to conduct annual judical surveys for the Tampa Bay area in order to provide some information to the public about our local judiciary.  Additionally, the committee seeks to work towards providing some feedback to the judges and improving the justice system.

I tried a case before Judge Silver and the fact that he was a good trial lawyer was evident from the way that he conducted the trial.  He was attentive and was prepared to rule on objections immediately and clearly understood the elements of the claim.

Judge Stephens has an excellent recall for the cases that appear before him which makes it easier for him to rule on issues when a case appears before him more than once.  The Judge is also well prepared and drafts well reasoned, substantial Orders.  This Judge is also one of the few who appears to truly understand his obligations when dealing with Daubert challenges.

NEGATIVE COMMENTS

It is the Policy of the Committee Promoting Judicial Excellence to provide only a description of any negative comments received regarding any Judge without divulging to which Judge those comments may have been directed. We believe that the rating system provides sufficient “constructive criticism” for any specific Judge, and stress that the survey is not intended to be used as a forum for ad hominem attacks or character assassination. Nonetheless, these negative comments are shared so that all Judges reviewing these comments can be aware of the various areas of sensitivity and concern expressed and possibly recognize areas of improvement they may choose to implement in the administration of their judicial responsibilities.

*  Condescending , Too “good ole boy”

*   Has too much faith in law enforcement witnesses.

*  He is very difficult to deal with and unprofessional to attorneys when things are not done as he expects or would like.

*  This judge is arrogant, rude and expects everyone to do his job for him . He has no business being a trial division judge in criminal.

*  While exceptionally smart, and well prepared, acts completely unprofessional on the bench, and frankly, does all he can to place his weight on the side of the Government.  In short, he is not qualified to be on the criminal bench because of his judicial temperament and lack of fairness to the accused.  The circuit would be better served if he were transferred to the Civil side of the house.

*  Fails to understand that her job is to apply the law, not to insert her own sense of justice. Repeatedly flaunts her wealth by snide comments throughout hearings. Unfair to people of a lower economic status.

*  Lack of professionalism.  She is rude to parties and counsel.  Lacks legal sense as well as practical sense.  Does not project well to those she purportedly is there to serve.  Negative attitude in conjunction with lack of legal acumen makes Judge __ the worst Judge in Tampa Bay to deal with or practice in front of.

*  Does not appreciate some rules of criminal procedure.  Values her docket control over fairness and professional courtesy to defense attorneys.

*  She is always on the side of the state (heard her say that).  Always showed her dislike for certain people.  Has out bursts in court when doesn’t like the parties.  Refuses to listen to the facts.  Law is not relevant, it is what she says.

*  Easily angered and shows it.  Wonderful human being, but needs to control his temper when it leads to negatively affecting his demeanor.

*  Has temper outbursts in the court room.  Will not always listen to both sides, minds already made up.  Overall he is a good judge, he deals in a difficult area.

*  If you routinely have saliva flying out of your mouth when you are on the bench then you’re probably not living up to the minimum standards aspired to for judicial demeanor.

*  Most of the time she is a great Judge, but I have seen the lack of fairness to both sides on occasions. Shows bias towards different attorneys.

*  Lacks professionalism towards defense attorneys.

*  Lady does not behave like a judge.

*  Outright bias for the state attorneys.

*  Obviously distracted by female attorneys.  Prefers to rule in their favor to woo them.

*  She needs to stop being a prosecutor.   She needs to believe everyone is innocent until they plead or are found guilty because they are.  Not a good judge.

*  State oriented, loves to punish, and is becoming a tyrant.

*  Get a hearing aid.  It’s why you find the background noise so annoying.

*  Only complaint is that he runs his courtroom like a kindergarten classroom, punishing everyone because it gets a little “loud” when people are whispering, and making speeches about how he does not like a noisy courtroom.

*  Speaks to fast which confuses the lay people who appear before him.

*  Always late. Is very slow.  His assistant is not motivated to work.  He should not be a judge.

*  No respect for people’s time.  Sentences people to a lot of time in order to coerce them into a plea.  Shows up often 45 minutes late to court when there are a hundred defendants and two dozen lawyers waiting, not to mention the bailiffs, clerk personnel, and probation.  He should not have the job.

*  Unprofessional demeanor.  Constantly refers to clients by first names which on many occasions has created an air that he was biased for one side. Speaks very fast and confuses lay people who appear before him.  Doesn’t listen but talks over people to the point attorneys have to repeat themselves 4 and 5 times.

*  Lazy

*  Belittles attorneys in front of parents (clients).  Bases ruling on what she wants, not necessarily the law.  Accuses attorneys of incorrect law when she is the one in error.

*  Fair, because she doesn’t like either side.  She treats her courtroom staff and attorneys as if they were her personal property. Absolutely absurd the time she makes everyone spend in her court. Deliberately makes things difficult on the lawyers.  Arrogant.

*  Definitely has shown bias in the past for the state vs. private attorney.  Once she realizes she can’t intimidate the attorney she is then is find, except for the bias.

* Seems government biased and is very grumpy.  Did not seem to have knowledge of basic legal doctrines and demanded caselaw for very well-known propositions.

*  Was a fish out of water in criminal.

*  Very knowledgeable of the law and able to manipulate it for the state.  Heavy handed and very unfair with his sentences.  Has a very obvious bias towards the state.  But is very courteous and professional.  Very good person away from work too.
