Congratulations to my good friend and colleague Luke Lirot on his 30th Anniversary Practicing Law

Congratulations Luke!  I have high admiration and respect for you.  You are a beautiful soul and fierce advocate who loves justice.  Your care and vigor in defending and fighting on behalf of your clients is inspiring.  You are sooooo cool and such a fun person to be around.  Love you.

Florida Statute 104.271 False or malicious charges against, or false statements about, opposing candidates; penalty.

(1)Any candidate who, in a primary election or other election, willfully charges an opposing candidate participating in such election with a violation of any provision of this code, which charge is known by the candidate making such charge to be false or malicious, is guilty of a felony of the third degree, punishable as provided in s. 775.082 or s. 775.083 and, in addition, after conviction shall be disqualified to hold office.

(2)Any candidate who, in a primary election or other election, with actual malice makes or causes to be made any statement about an opposing candidate which is false is guilty of a violation of this code. An aggrieved candidate may file a complaint with the Florida Elections Commission pursuant to s. 106.25. The commission shall adopt rules to provide an expedited hearing of complaints filed under this subsection. Notwithstanding any other provision of law, the commission shall assess a civil penalty of up to $5,000 against any candidate found in violation of this subsection, which shall be deposited to the account of the General Revenue Fund of the state. (Should this section also be subject to a felony of the third degree and disqualification of office?  Should this statute also penalize PACs and candidates who provide false information about themselves to gain an election advantage? Currently just a $5k penalty for deceiving during a campaign against an opponent.


Voters deserve to hear the full truth about candidates running for office (regardless of whether it is truth that a candidate wishes to hide) since they are seeking to exert power that affect our lives and are the recipients of public monies.  If you want to hold public office, you are fair game for complete scrutiny, skeletons and all.  If you can’t take the public heat then get out of the public kitchen and go back to being a private citizen.    For those of you who think it is ok to spread falsehoods in order to gain control/power, voters are beginning to get pretty fed up and this blog intends to point a very intense spotlight on you when you lie or recklessly disregard truth because you value power above integrity.  I want dirty/lying politicians out of office.  It is the responsibility of every citizen in a representative republic to do their part to ensure that only the most highly qualified and with the highest level of integrity stay in office or are put in office.  Conversely, it is also their responsibility to politically crucify the Pontius Pilates that govern or attempt to grab hold of power.

13 Then Pilate called together the leading priests and other religious leaders, along with the people, 14 and he announced his verdict. You brought this man to me, accusing him of leading a revolt. I have examined him thoroughly on this point in your presence and find him innocent. 15 Herod came to the same conclusion and sent him back to us. Nothing this man has done calls for the death penalty. 16 So I will have him flogged, and then I will release him. 18 Then a mighty roar rose from the crowd, and with one voice they shouted, Kill him, and release Barabbas to us 19 (Barabbas was in prison for taking part in an insurrection in Jerusalem against the government, and for murder.) 20 Pilate argued with them, because he wanted to release Jesus. 21 But they kept shouting, Crucify him! Crucify him! 22 For the third time he demanded, Why? What crime has he committed? I have found no reason to sentence him to death. So I will have him flogged, and then I will release him. 23 But the mob shouted louder and louder, demanding that Jesus be crucified, and their voices prevailed. 24 So Pilate sentenced Jesus to die as they demanded. 25 As they had requested, he released Barabbas, the man in prison for insurrection and murder. But he turned Jesus over to them to do as they wished. Luke 23:13-25
