Kevin Reed, a Commercial Driver’ s License holder, was fined for speeding in the City of Clearwater last year. Mr. Reed was cited for going 50 MPH over the speed limit. Mr. Reed’s driving history included a 1998 speeding infraction that was 23 MPH over the speed limit. Florida Statute 318.18(3)(b), which sets out the fine amounts for speeding violations, sets a $250.00 maximum fine for infractions exceeding 30 MPH. Mr. Reed appeared before Senior Judge Karl Grube who ordered a fine of $2,500. John McQuire, Reed’s attorney, appealed Judge Grube’s fine imposition as excessive. Circuit Court Judge Thane Covert, addressing the issue of whether Judge Grube’s order resulted in an excessive fine, remanded the case back finding no legal reason had been presented justifying the $2,500 fine. If there is a basis that justifies exceeding the statutory fine amount then it should be specifically stated according to Judge Covert’s order and opinion.
